By submitting an Open Farms event on the www.openfarms.co.nz website, you acknowledge and agree that:
- You have the right to, or have obtained the required permission to, host an Open Farms event on the property you register with Open Farms Limited (Open Farms).
- You accept responsibility as the designated Person Conducting a Business or Undertaking (PCBU) for your Open Farms event. You acknowledge that this responsibility is not transferable.
- You meet the requirements to register as an Open Farms host:
- You are actively involved in food and/or fibre production in New Zealand.
- The property you intend to register for an Open Farms event is compliant with all current local council, regional council, sector body or national regulations.
- You agree to adhere to the Open Farms Code of Conduct.
- You agree to complete a Risk Assessment and enact all required safety measures prior to your Open Farms event.
- You agree to adhere to the Health, Safety & Biosecurity guidelines provided by Open Farms, to the best of your ability and as is reasonably practicable to do so.
- You agree to comply with any additional, reasonable rules and regulations pertaining to hosting an Open Farms event.
- You agree to inform your insurance company of your intention to host an Open Farms event and ensure that your farm has the required level of public and statutory liability insurance, as recommended by your insurance company.
- You will participate in Open Farms in a manner that does not endanger yourself or others.
- You and your contractors and subcontractors (if any) shall strictly abide by your separate and conjoint responsibilities under the Health and Safety at Work Act 2015 at all times whilst on site prior to, during and after the Open Farms event hosted by you.
- You agree to comply with local bylaws, regulations and Acts of Parliament and other requirements which govern the Open Farms event.
- Open Farms reserves the right to cancel or postpone an Open Farms event by notice in writing (or orally in the case of emergency) in the event of any occurrence which in the opinion of Open Farms it is justified in doing so.
- You agree that to the extent permissible by law, the organisers of Open Farms (including its officers, sponsors, employees, subsidiaries, guests, contractors or other stakeholders) and other parties associated with the event, have no liability to you whatsoever for any direct, indirect or consequential loss, sustained by you during, or in any way related to, your participation in Open Farms.
- Open Farms shall be under no liability for the loss of or damage to you or your property, or that of your servants, agents, invitees or licensees, howsoever such loss or damage may be caused, and whether or not caused in whole or in part by the negligence or other actions of Open Farms, its servants or agents.
- You acknowledge, understand and assume any risks involved in participating in Open Farms. You understand and acknowledge that Open Farms provides no warranties, regarding your wellbeing, safety and property.
- You shall be liable for any taxes, duties, fees or charges which might now or at any time hereafter become liable in respect of these terms and conditions.
- You authorise the use and assignment of your voice and/or likeness in pictures/video recording in any broadcast, promotion, advertising, any other current and/or future media technologies and in any other way to Open Farms, without payment or any other form of compensation.
- Open Farms gives no warranty as to the type or extent of promotion of the Open Farms event hosted by you, nor as to the attendance numbers.
- You understand and agree that situations may arise during Open Farms, which may be beyond the control of the organisers.
- Open Farms may assign its rights and obligations under these terms and conditions.
